In the crime of perjury, there is often a requirement that the lie or intentional false testimony must be material to the outcome of the proceeding. A witness, for example, may lie about something that is not central to determining whether a criminal defendant is guilty and it not be considered perjury.
Penal statutes often require that fraud requires some material falsehood or misrepresentation to a victim about some fact or circumstance.
