certain characteristics of a person that makes them incapable of performing some act, e.g., entering into a contract or writing a will. Examples include: infancy/minority (a person below 18 years of age), mental infirmity (mentally unstable), or intoxication. A person who is legally incapable of entering into a contract can only enter into voidable contracts or contracts that can be voided by the legally incapable party.
