drunk; loss of faculties as a result of ingesting or consuming some drug, particularly alcohol. The effects of intoxication may or may not alter the rights of parties in different circumstances.

 

Contracts: Intoxication can render a contract voidable (the person can back out of it, but they don’t have to). However, an extreme level of intoxication is required, and the other party must have reason to know of the intoxication in order to back out of the contract. Furthermore, an intoxicated person must be unable to understand in a reasonable manner the nature and consequences of the transaction, or she must be unable to act in a reasonable manner in relation to the transaction.

 

Criminal Law: Voluntary intoxication normally is not a defense to the commission of a criminal act. Intoxication, though, is often offered as a mitigation of guilt.
