the old rule was that if a nuisance (interference with someone’s land) existed before you moved in, you could not sustain a nuisance claim. However, based on fairness, and the fact that if the nuisance existed before a person got there, the person likely bought the land at a significantly reduced price because of the presence of the nuisance, and therefore, nuisance becomes their own seeking.
