compensatory damages

damages or monetary relief issued by the court to compensate for the loss due to a tort or breach of contract. Compensatory damages are designed to make injured parties “whole,” that is compensate them for all past and future losses sustained as a result of an injury.

Compensatory damages include a wide variety of categories of damages under the broad categories of Economic Damages and Non-Economic Damages.

 

Economic damages refer to specific, quantifiable financial losses and may include lost profits, lost wages or earning capacity, out-of-pocket expenses, reasonable medical expenses.

 

Non-economic damages refer to the more difficult measure emotional and psychological losses parties may suffer as a result of an injury or the death of a loved one. They include mental anguish, pain and suffering, disfigurement, physical impairment, humiliation, loss of society, loss of protection, and loss of consortium.
