In federal statutes, in particular, quid pro quo is often the requirement to prove bribery. By comparison, lesser offenses for gifts, “things of value,” and other “illegal gratuities” also exist. In those instances, an offense may have occurred but without having to prove the exact purpose of the illegal gratuity. The gift itself and it’s potential for corrupting the official serve as the basis for the criminal statute.
