Independent contractor

when an employer lacks control over how one performs his/her work or over the means of a person’s work, that person is an independent contractor. This is relevant with regards to vicarious liability (liability for the employer for the acts of his employee). If a person is held to be an independent contractor as opposed to an employee, the employer will not be liable for the acts of an independent contractor.
