Market share liability

: if a certain product causes harm to a person and that person cannot identify the defendant, each defendant who makes that product is liable for the portion of damages equivalent to its market share unless it is able to demonstrate definitively that it could not have been the company who sold the drug. For this occur, the product in question must be fungible (identical).
