Modified comparative negligence

a plaintiff’s (injured person) recovery is reduced in proportion to the percentage of negligence (lack of due care) attributed to him. In addition, he/she can only recover when either plaintiff’s negligence does not exceed 50%; or plaintiff’s negligence is less than 49% (approaches 1 and 2 vary by states, but 49% is majority approach as about half states use it)
