Mutual mistake

a mistake of both parties at the time a contract is made as to a basic assumption or fact​, i.e., both parties share a mistaken belief, not in accord with the facts, which has a material effect on the agreed exchange of performances. Mutual mistake renders ​a contract voidable by the adversely affected party​.
