Strict liability applies in Ultra Hazardous Activities and Wild Animals. Products liability actions were previously characterized as strict liability and sometimes are still characterized as such. That is no longer the case as plaintiffs have to prove defect and other matters and overcome an increasing number of defenses in design and warnings defect claims concerning the benefit versus the cost of some safety measure.
